These Terms of Service (“Terms”) govern your access to and use of Heated Room’s website, studios, classes, memberships, packages, retail purchases, and related services (collectively, the “Services”). By accessing our website, creating an account, booking a class, purchasing a membership or package, or entering a Heated Room studio, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.

1. Eligibility

You must be at least 18 years old to purchase or participate in Heated Room Services. Minors may participate only with written consent from a parent or legal guardian and approval from Heated Room.

2. Nature of Services & Health Disclaimer

Heated Room offers infrared-heated fitness classes that involve physical exertion. By participating, you acknowledge and agree that:

  • You are physically able to participate and have no medical condition that would prevent safe participation.

  • Heated and high-intensity exercise carries inherent risks, including dehydration, dizziness, overheating, muscle strain, or injury.

  • You assume full responsibility for monitoring your physical condition during class and stopping if necessary.

Heated Room does not provide medical advice. You should consult a physician before beginning any fitness program.

3. Client Responsibility

Clients are responsible for maintaining proper hydration and monitoring their physical condition during classes. Heated Room is not responsible for adverse effects resulting from dehydration, overexertion, or failure to follow instructor guidance.

4. Waiver & Assumption of Risk

By using our Services, you voluntarily assume all risks associated with participation. To the fullest extent permitted by California law, you release Heated Room, its owners, employees, instructors, contractors, and affiliates from any claims, injuries, or damages arising from participation, except where prohibited by law.

5. Accounts, Booking & Platforms

All bookings, memberships, packages, and payments are processed through Mariana Tek. Our website is hosted on Squarespace.

You are responsible for maintaining accurate account information and keeping your login credentials secure. Heated Room is not responsible for unauthorized access resulting from your failure to safeguard your account.

6. nstructor Substitution & Schedule Changes

Heated Room reserves the right to modify class schedules, instructors, class formats, and studio offerings at any time without notice. Instructor substitutions or schedule changes do not constitute grounds for refunds or extensions.

7. Memberships

Memberships are billed automatically according to the selected plan at the time of purchase. Membership benefits, class limits, and studio access vary by plan. All memberships are non-transferable and non-refundable, and may only be paused or modified in accordance with the specific terms and conditions of the individual membership plan.

Heated Room reserves the right to modify membership offerings, pricing, and benefits with notice.

8. Heated Environment Acknowledgment

Heated Room classes take place in an infrared-heated environment. Studio temperatures, humidity levels, and infrared exposure may vary. By participating, you acknowledge and accept the environmental conditions of the studio.

9. Pregnancy & Special Conditions Disclaimer

Clients who are pregnant, postpartum, or have medical conditions should consult a physician prior to participation. Heated Room is not responsible for complications arising from participation under such conditions.

10. Class Packages & Expiration (California Disclosure)

All class packages purchased through Heated Room expire one (1) year from the date of purchase, unless otherwise explicitly stated at the time of purchase or as part of a promotional offering.

Expiration dates are clearly disclosed prior to purchase. Unused classes are forfeited upon expiration and are non-refundable, non-transferable, and may not be extended unless required by applicable California law.

11. Studio Closures

Heated Room shall not be held liable for class cancellations, closures, or service interruptions due to events beyond our control, including but not limited to weather conditions, natural disasters, power outages, governmental orders, or emergencies.

12. Promotions & Special Offers

Promotional offers:

  • Are subject to specific terms disclosed at purchase

  • Are non-refundable and non-transferable

  • Cannot be combined unless explicitly stated

  • May include additional restrictions, including expiration or access limits

All promotional packages or codes must be activated upon purchase. Activation dates cannot be changed.

13. Autopay & Billing Authorization

If a payment is declined, your card expires, or billing fails:

  • Access to Services may be paused until payment is resolved

  • You remain responsible for outstanding balances

By enrolling in a membership or autopay plan, you authorize Heated Room to charge your payment method on file on a recurring basis.

  1. Cancellation & No-Show Policy

  2. Classes must be canceled within the cancellation window (10 hours before the class start time) to avoid any associated penalty fees or forfeiture of the class credit.

  3. Late cancellations or no-shows may result in forfeited credits and penalty fees.

  4. Policies may vary by membership or promotion and are subject to change.

All no-shows are subject to a $10 fee and late cancellations are subject to a $5 fee. A $10 mat occur if you fail to check in at the front desk upon arrival for your class.

14. Studio Conduct & Policies

To maintain a safe and respectful environment:

  • Clients must arrive on time. Late entry (past the 5-minute grace period) may be denied.

  • Appropriate workout attire is required.

  • Disruptive, disrespectful, or unsafe behavior will not be tolerated.

Heated Room reserves the right to refuse service, revoke access, or terminate memberships at its discretion.

15. Photography, Video & Likeness Consent

By entering a Heated Room studio and participating in classes or services, you acknowledge and agree that photographs or video recordings may be taken within the studio by clients or Heated Room staff.

You grant Heated Room a non-exclusive, royalty-free, worldwide license to use, reproduce, repost, publish, and display any photos or videos you voluntarily appear in or share, tag, or submit to Heated Room, including content in which you may appear incidentally in the background, for marketing, promotional, and social media purposes.

If you do not wish to be featured in studio-generated or reposted content, you may notify a Heated Room team member or contact us in writing, and we will make reasonable efforts to honor your request.

16. Retail Sales

All in-studio retail purchases are final sale unless otherwise stated. Heated Room is not responsible for lost or stolen personal items.

17. Intellectual Property

All content on the Heated Room website and in-studio materials, including logos, trademarks, text, graphics, images, branding, music or playlisting, and class structure, is the exclusive property of Heated Room and may not be used without written permission.

18. Modifications to Services & Terms

Heated Room reserves the right to modify Services, schedules, pricing, and these Terms at any time. Continued use of Services constitutes acceptance of any updates.

19. Limitation of Liability

To the fullest extent permitted by law, Heated Room shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

21. Policy Enforcement Discretion

Heated Room reserves the right to interpret, enforce, and apply these policies at its discretion to ensure the safety, fairness, and integrity of its Services.

22.Lost & Personal Property Disclaimer

Heated Room is not responsible for lost, stolen, or damaged personal belongings brought into the studio, including items stored in lockers, common areas, or studio spaces. Clients are encouraged to secure their personal items at all times.
